11.13 Subcontract Final Certificate (11410m)
Unfortunately it appears there are some contractors who thrive on contractual litigation. While it may be true that obtaining a Final Certificate will not stop the claims, it is a valuable step in managing the outcome.
The worst case a Muli User has brought to our attention is that of an excavator with a contract of $340,000. After having received final payment the excavator submitted an additional variation in excess of $400,000!!!
Again, Muli recommends you have your legal adviser review the wording of the Final Certificate to ensure it is appropriate for your contracting requirements.
When the Final Certificate feature is turned on [19.2], a Project Administrator would use the Subcontract Progress Claim [11.11] to raise a subcontract final certificate. This would be initiated when the approved for payment is equal to the contract value (before retention is taken into account). The system would then place a "stop" flag on the payment until a signed certificate was received.
